Born in Ohio, Ross Burns relocated to Topeka, Kansas, and started a law practice. Residing in Topeka, Kansas, Ross Burns mustered in August, 1863, as captain of Battery A (also known as the Topeka Battery), 2d Kansas State Militia. Called to active duty on October 10, 1864 to defend the state during Price’s Raid. Burns was severely wounded and taken prisoner during the action at Mockbee Farm on October 22, 1864. Burns was released from duty on October 30, 1864. Burns never fully recovered from his wounds, but returned to Topeka to continue the practice of law. Burns held the position of City Attorney for Topeka. He later organized the Law Department for the Atchison, Topeka and Santa Fe Railway Company and became its first solicitor.
